Patent Litigation – Expanding Garden Hose

RAH Consultancy had not previously been involved in patent litigation as an expert witness. This case provided valuable expertise in the nuances of patent disputes and has since equipped the team for future cases.

The matter concerned the inventor of an expanding garden hose whose patented invention had been copied by a major manufacturer. The inventor asserted that the manufacturer had no right to copy the product and market it in competition with his own. The manufacturer took a different view and challenged the patent.

RAH Consultancy acted as the expert for the hose inventor. The work included laboratory experiments designed on behalf of the client, together with method statements, calibration statements, and related documentation. During the progress of the case, the team also reviewed and commented on the opposition’s experimental data and witnessed the repeat of these tests for the client. In addition, reports were produced and detailed commentary was provided on the opposition’s reports.

Richard Hurst, supported by his staff, invested considerable time researching the manufacture and history of this type of water device. Ultimately, the team spent five days in court supporting the inventor’s arguments.
